3. Account Registration
To access certain services, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Maintain the security of your password and account credentials
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use or security breach
We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.
4. Purchases and Payment
4.1 Pricing
All prices are listed in US Dollars (USD) and are subject to change without notice. Prices include applicable taxes unless otherwise stated. We reserve the right to modify pricing for services and courses at our discretion.
4.2 Payment Terms
- Payment is required in full at the time of purchase unless alternative arrangements are agreed in writing
- We accept major credit cards, debit cards, and other payment methods as displayed
- Payment processing is handled by secure third-party payment processors
- For consulting services exceeding $5,000, installment payment plans may be available
4.3 Order Confirmation
After placing an order, you will receive an email confirmation containing order details. This confirmation does not constitute acceptance of your order. We reserve the right to refuse or cancel orders at our discretion.
5. Course Enrollment and Access
5.1 Enrollment
- Course enrollment is confirmed upon receipt of full payment
- Access credentials will be provided within 24 hours of enrollment confirmation
- Course start dates and schedules are specified in course descriptions
- Minimum enrollment numbers may be required for certain courses
5.2 Course Access
- Online courses provide lifetime access to course materials unless otherwise specified
- Live sessions must be attended at scheduled times; recordings may be available
- Course materials are for personal use only and may not be shared or distributed
- Technical requirements for course access are specified in course descriptions
6. Consulting Services
6.1 Service Delivery
- Consulting services are provided according to the scope defined in the service agreement
- Project timelines and deliverables are specified in individual contracts
- Services are delivered by qualified professionals with relevant expertise
- Client cooperation and timely provision of information are required for successful delivery
6.2 Client Responsibilities
- Provide accurate information and necessary access to systems/personnel
- Respond to requests and queries within agreed timeframes
- Designate appropriate personnel for project coordination
- Implement recommendations at your own discretion and risk
7. Intellectual Property Rights
7.1 Our Content
All content on our website and in our courses, including text, graphics, logos, images, videos, software, and course materials, is owned by IT ConsultPro or our licensors and is protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable license to:

- Download materials explicitly marked as downloadable

- Preparation for third-party certification exams does not guarantee passing those exams
- We reserve the right to withhold certificates if Terms are violated or fraud is detected
10. Limitation of Liability
To the maximum extent permitted by law:
- Our services are provided "as is" without warranties of any kind
- We do not guarantee specific results, outcomes, or career advancement
- We are not liable for indirect, incidental, consequential, or special damages
- Our total liability shall not exceed the amount paid by you for the specific service
- We are not responsible for third-party content, links, or services
- Implementation of consulting recommendations is at your own risk
11. Indemnification
You agree to indemnify, defend, and hold harmless IT ConsultPro, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

- Your use or misuse of our services
- Your infringement of any intellectual property or other rights
- Your violation of applicable laws or regulations
12. Confidentiality

We will maintain confidentiality of your proprietary information disclosed during consulting engagements, subject to exceptions required by law.

You agree to keep confidential any proprietary methodologies, frameworks, or materials provided by us that are marked as confidential.
13. Termination
13.1 By You
You may terminate your account by contacting us. Termination does not entitle you to refunds except as specified in our Refund Policy.

We may suspend or terminate your access to services immediately if:
- You violate these Terms
- You engage in fraudulent or illegal activities
- Payment obligations are not met
- Your conduct harms our business or reputation
13.3 Effect of Termination
Upon termination:
- Your right to access services ceases immediately
- Provisions regarding intellectual property, liability, and indemnification survive
- Outstanding payment obligations remain due
14. Dispute Resolution

These Terms are governed by the laws of South Africa, without regard to conflict of law principles.

15. Force Majeure
We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, governmental actions, internet failures, or pandemics.
16. Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website with an updated "Last Updated" date. Material changes will be communicated via email to registered users. Continued use of services after changes constitutes acceptance of modified Terms.
17. General Provisions
17.1 Entire Agreement
These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and IT ConsultPro regarding our services.
17.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
17.3 Waiver
Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
17.4 Assignment
You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.

These Terms do not create any third-party beneficiary rights.
